The subject of this study is the activity of the court in determining the punishment. Considered as a judicial activity, the determination of the punishment is carried out in compliance with the principles of legality and individualization of the punishment. In addition, individualization of the punishment in the practice of the courts is discussed in a separate point. Attention has been paid to the importance of mitigating and aggravating circumstances, as well as to the rules for reduction of punishment when there are exceptional or numerous mitigating circumstances.
