dc.description.abstractThe fiducia contract is regulated in the recently adopted New edition of the Romanian Civil Code (2009/2011). This is a novelty in comparison with the older version. The name of this type of contract is taken from the Latin legal language of Roman tradition, and the model adopted by the Romanian legislator is French, as the institution itself was recently (2007) introduced in the French Civil Code. However, as the content is inspired by the Anglo-Saxon trust, some terminological clarifications are necessary.
