The purpose of the article is to analyze the distribution of the burden of proof in constitutional litigation. The author's considerations are set out in the context of the approach adopted by the Bulgarian Constitutional Court in Case No. 1/1995, according to which failure to submit evidence requested by the Court may lead to certain adverse legal consequences for the party to the proceedings who fails to submit them.
